1. Access to and use of this site ('atpdirectory.com’ “the Site”) is provided by Air Transport Publications Ltd (“ATP”), 131 Edgware Road, London, W2 2HR, UK. Throughout the Site, the terms "we," "us" and "our" refer to ATP. ATP offers this Site, including all information, tools and services available on this Site, to you, the user (“User”), on the condition that you accept all the terms, conditions, policies and notices stated in these Terms and Conditions ("Terms"), and that you agree to comply with all applicable laws and regulations. Your use of this Site constitutes your agreement to these Terms, and by using this Site you agree to be bound by these Terms. If you do not agree to be bound by these Terms, you must not use the Site.


2. ATP may change these Terms at any time by posting changes online. Please review these Terms regularly to ensure you are aware of any changes made by ATP. Your continued use of the Site after changes are posted means you agree to be legally bound by these Terms as updated and/or amended.


Use of the Site


3. All content provided on or offered through this Site (including, but not limited to, text, files, images, graphics, illustrations, audio, video, and photographs) (collectively, "Content") is owned by ATP.  The Content of the Site is protected by copyright (unless otherwise indicated). As a User, you have certain rights set forth below; all other rights are reserved.


4. Your access to or use of the Content is subject to the Terms, including the following.  Unless otherwise agreed in writing all of the Content is rented to you for a period of 1 year from the start of rental. You do not own the Content. You may only use the Content for the research and marketing purposes of your own business, or for the same purposes for your own personal use.  The resale, re-distribution, reproduction, modification, passing on, display, creation of derivative works,  publishing or reprinting of any of the Content is strictly forbidden. Data is seeded and actively monitored against misuse.


5. The names, images and logos identifying ATP or third parties and their products and services are subject to copyright, design rights and trade marks of ATP and/or third parties. No permission is given in respect of the use of any such trade marks, logos, get-up, product or company names where such use may infringe the holder’s rights. Nothing contained in these terms shall be construed as conferring by implication, estoppel or otherwise any licence or right to use any trademark, patent, design right or copyright of ATP or any other third party.


6. You may use this Site only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the Site and its related websites. Prohibited behaviour includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of dialogue within the Site. You may not use the Site:


  • in any way that breaches any applicable local, national or international law or regulation;
  • in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
  • to send, knowingly receive, upload, download, use or re-use any material which does not comply with the content standards set out below;
  • to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); or
  • to knowingly introduce or transmit any viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other materials, codes or programs that are malicious or technologically harmful.
  • You also agree not to reproduce, duplicate, copy or re-sell any part of this Site in contravention of the provisions of these Terms; and not to access without authority, interfere with, damage or disrupt any part of this Site, or any computers, servers or databases connected to or with this website; or any equipment or network on which this Site is stored; or any software used in the provision of this Site; or any equipment, network or software owned or used by any third party.


Disclaimers and Limitation of Liability


7. The Content of the Site and its related websites, including the information, names, images, pictures, logos and icons regarding or relating to ATP, its products and services (or to third party products and services), is provided "AS IS" and on an "AS AVAILABLE" basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.


8. Under no circumstances will ATP be liable for any of the following losses or damage (whether such losses were foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of the Site regardless of the form of action.


9. ATP does not warrant that functions contained in the Content will be uninterrupted or error free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or bugs. If the User downloads any Content to his/her computer or takes the Content from the Site in any other way, it is at his or her’s own risk. ATP will not be responsible for any damage to the User’s computer or any of the information on it. 


10. The Site contains links to third-party websites which are not under ATP’s control or maintained by ATP. ATP is not responsible for the content of those websites. Links to third-party websites are provided for the user’s convenience only and ATP does not necessarily endorse the materials on these websites.


Accounts and Passwords


11. Where Users of this Site set up and access a secure, password-protected account or other area on this website (“Account”), the following additional terms will apply:


  • If you choose, or you are provided with, a username, password or any other piece of information as a part of our security procedures, you must treat such information as confidential. You must not disclose such information to any other person.
  • Only you may access and use your Account. You must not permit or enable any other person to access or use your Account. All accounts on the Site are single-user licences.
  • At any time, we may disable any username, password or other security information, whether chosen by you or provided by us, and disable access to your Account, if, in our reasonable opinion, you have failed to comply with any of the provisions of these Terms.


Suspension and Termination


12. ATP will determine, in its absolute discretion, whether there has been a breach of these Terms. When such a breach has occurred, ATP may take whatever action it deems appropriate.  A  breach of these Terms may result in ATP taking all or any of the following actions:


  • immediate, temporary or permanent withdrawal of your right to use the Site (including, without limitation, your Account, if applicable);
  • issue of a warning to you;
  • legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
  • further legal action against you; and/or
  • disclosure of such information to law enforcement authorities as ATP reasonably feels is necessary.


13. ATP excludes liability for actions taken in response to breaches of these Terms. The responses described in these Terms are not limited, and ATP may take any other action that it reasonably deems appropriate.


14. If, as a result of any action taken pursuant to this section, ATP closes your Account (if applicable), all data and information in and relating to that Account will be deleted and lost. ATP will not be liable to you for any such deletion or loss.




15. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.




16. No failure by ATP in exercising any rights under these Terms shall prejudice or restrict its rights or operate or be construed as a waiver thereof. Any single or partial exercise of any such rights shall not preclude other or further exercise thereof or the exercise of any other right. No waiver of any breach of these Terms shall be held to be a waiver of any other or subsequent breach.


Force Majeure


17. ATP shall not be liable for any breach of these Terms or any failure to provide or delay in provision of any services through the Site resulting from any event or circumstance beyond its reasonable control, including, without limitation, any Acts of God, strikes, lock outs and other industrial disputes, breakdown of systems or network access, fire, flood, explosion or accident.




18. These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.
